E-Laws (Digital Laws)

WHAT DO I COVER IN A KEYNOTE TALK ABOUT E-LAWS (DIGITAL LAWS)?

 

It’s interesting to think about and acknowledge that most of our laws were made for brick and mortar, flesh and blood. However, in this day and age, there is a new world, a digital one, and it needs to be governed; it cannot be done so using old laws. So how do we manage this new realm, and why should we?

I have always loved law, and I am particularly passionate about sharing insights on digital law. Within a keynote talk, I might cover:

An Introduction to E-Law, with a definition and scope of E-Law and a bit of a historical background on the evolution of laws addressing digital environments.

I’ll then move on to talking about the Legal Frameworks in the Digital Age, including points on existing laws and regulations (e.g., GDPR, CCPA) and, of course, those specific and applicable to the guests at the talk. For example, if the keynote talk is for South Africans, I would include insights on the RICA Act of 2002, The Electronic Communications and Transactions Act of 2002, The Protection of Personal Information Act of 2013, and of course, the Cybercrimes Act of 2020. I will also cover jurisdictional issues in cyberspace and some interesting differences in digital laws across regions and countries.

Next, I might tackle Intellectual Property Rights. The protection of digital content (copyright, trademarks, patents) is a real concern for several businesses because there are many challenges in enforcing IP rights in a global context.

Cybersecurity and Data Protection is the next core topic of discussion. I will cover the importance of being proactive and how vital E-Security and E-Digital Policy are for each business.

If applicable to the guests, I might also talk about e-Contracts and Digital Transactions; I’ll unpack the legal validity of electronic contracts and the key considerations in digital agreements and signatures. I might also cover litigation and dispute resolution in E-Law.

I’ll end the talk by discussing some Emerging Technologies and Their Legal Implications. I generally include the impact of blockchain, AI, and cryptocurrencies on existing laws. I will also include points on future legal challenges posed by the rapid advancement of technology, predictions for evolving legal landscapes due to technology, and the role of legal professionals in shaping digital laws.

I often invite one of my legal practitioner colleagues to co present these sorts of keynote talks with me and we add a Q&A at the end of the talk which is always enjoyed.
